摘要

透明度原则是WTO的基本原则之一,它在保持国际贸易的可预见性和稳定性中发挥着重要的作用。本文首先阐述了透明度原则出现的原因，分析了透明度的两个要点：贸易政策法规的公布和通知。然后分析了成员在透明义务履行方面存在严重问题的原因。并就如何促进各成员遵守透明义务提出了建议：改进通知程序和促进遵守通知义务，加强对透明义务履行情况的审查。最后一部分本文就我国如何提高透明度做了深入的分析：阐述了我国入世议定书中关于透明度做出的承诺；我国政府在履行透明度原则方面存在的问题；提高我国政府透明度的建议，包括提高行政立法和执法透明度，制定《政府信息公开法》和《行政程序法》，完善我国司法审查制度，公开司法审查全过程。

Abstract

The transparency principle is one of WTO’s basic principles, and it plays an important role in maintaining predictability and stability of world trade. The thesis first explains the causes for the transparency principle and the two key points of it -- the publication and notification of trade policy. Then it analyzes the cause of the existence of serious problems when members of WTO are performing their duties. The thesis offers suggestions on improving the transparency procedure and promoting its members to comply with the transparency obligations. The last part the thesis analyzes on how to improve our government’s transparency, including the commitments that our country makes, the problems when our country are performing the duties and the suggestion of improving government’s transparency which including improving the transparency of government’s administrative legislates, making administrative procedure law and law for disclosing government’s message, and perfecting the judicial review.

WTO体制下的透明度原则新探

1 透明度原则概述
透明度原则是WTO的基本原则之一，首先由1947年的关贸总协定提出，后经乌拉圭回合谈判纳入了各个多边贸易协定，现已适用于国际贸易的所有领域，成为货物贸易、服务贸易和知识产权保护中普遍实行的一项基本原则。根据规定，WTO成员要及时以官方形式公布其所制定和实施的与贸易有关的法律、法规、政策和做法以及有关的变化情况(如修订、增补或废除等)，不公布的不得实施，同时，还应将这些法律法规、政策和做法以及有关的变化情况通知WTO。世界WTO所参加的影响国际贸易政策的有关国际协议也在公布和通知之列。
在关贸总协定乌拉圭回合中，又通过建立“贸易政策审议机制”，使透明度原则得到强化。该机制不仅要求WTO成员方及时公布协议所要求的所有法律文件而且要求其贸易政策和做法接受WTO贸易评审机构的定期审议，并定期向该机构报告其贸易政策和实施情况。透明度原则的主要意图在于保持WTO各成员方政策和措施的充分透明，保持国际贸易开放、公平的健康发展。
