（页数：12 字数：9026 毕业论文）摘 要：近二十年来中国社会由于从国有制计划经济向现代市场经济制度转型所发生的巨大变化，以及社会分层的明晰化，使得生存权无论在对个体中国人的一般生活和心理影响方面，还是在对社会各阶层的实际影响方面都具有了更重要的和日益迫切突出的意义。当普通民众生存权遭到威胁时，更在反复检验着目前国家宪政的合法性；而当国家的独立和生存成为问题时，人民的生存也难有保障。最终要落脚到中国国家的整体生存权上。当前，宪政理论要适应宪政现实的需要，就迫切需要把生存权问题提到更突出的高度，放在与时代社会相称的位置上予以探究。

Abstract ：In the recent two decades, thanks to the great changes from State-Owned Enterprises and planned economy to modern market-oriented economy in China, and the explicitation of the social class, subsistence right(the right to live) has became a more important and urgent need not only to the aspect of common lives and psychological affects of the Chinese individuals ,but also to the practical influence of each social class. Common people's subsistence right being threatened, repeatedly checks the legality of the current constitutionalism in the country;however, when a country's independence and existence are in danger, people's subsistence rights cannot be guaranteed. That is why people's subsistence rights must be based on the subsistence right of the Chinese country. If we want to make the theory of constitutionalism meet the practical needs of constitutionalism at present time ,we'll be urgent for raising up the status of the subsistence right and having researches into it at a proper status fitting the modern society.

引 言
出于融入国际社会的需要，为回应西方长期以来在人权问题上的质疑和批评，1991年11月1日中华人民共和国国务院新闻办公室发表了我国历史上第一份人权白皮书《中国的人权状况》，指出“生存权是中国人民长期争取的首要人权”[1]。其后国务院又发布了若干次年度人权白皮书，重申这一立场。在2005年官方又在原有论点上进一步扩充“首要人权”的内涵，提出“生存权和发展权是首要的基本人权”[2]。问题的最早提出带有回应西方人权批评的策略性质，距今已有十七年了，时代和社会发生了巨变，提出问题的背景大为不同了，社会出现了一种新中国成立以来未曾有过的阶层分化，用学者的话来说就是“改革共识断裂”。我国学者一般对生存权的认识主要表现在概念和中国的现实需要上，对生存权在中国的意义则少有专门论述。为引起思想界对生存权问题的关注，同时将此问题上升到法权理论层面，为制度改良等社会进步活动提供理论支持，都迫切需要明确生存权在当代中国的意义。
