（页数：14 字数：10208 毕业论文）摘 要：体育仲裁制度是一种行之有效体育纠纷解决方式，在体育纠纷解决领域中发挥着重要功能，为世界大部分国家和地区所采用。但反观我国的体育纠纷解决领域，体育仲裁立法单薄、体育仲裁实践空白，这种体育法制建设相对滞后的状况如果不能得到彻底的改变，必将成为影响和制约我国体育事业未来发展的重要因素。本文将以体育仲裁的根源——体育纠纷作为切入点，把我国现今的我国的体育纠纷解决机制作为支点，从我国构建体育仲裁制度的必要性，可行性，应遵循的原则，法律依据，仲裁机构，仲裁程序等方面论述我国体育仲裁制度的构建。我国体育仲裁机制的构建应注意其专业性，要有专门的仲裁机构，专门的仲裁规则，专业的仲裁人员，仲裁范围的确定应符合其专业要求。

ABSTRACT ：Sports arbitration system is an effective way to resolve sports disputes, resolve disputes in the field of sports play an important function, most of the world's countries and regions adopted. 引 言
我国体育运动的商业化、全球化的飞速发展，导致各种体育纠纷不断涌现，如何解决体育纠纷逐渐成为人们关注的问题，而体育仲裁作为专业仲裁的一种，以其迅速、保密、费用低的特点倍受众多纠纷当事人及体育组织的青睐。体育仲裁，是指在竞技体育活动中发生争议的双方当事人，根据在争议发生前或争议发生后所达成的有关仲裁的协议，自愿将争议事项交由体育仲裁机构进行裁决，各方自动履行裁决义务的解决体育争议的方式和活动，是依据国家的仲裁法规和体育法规建立的解决体育争议的一项体育法规制度。
