（页数：18 字数：11004 毕业论文）摘要: 发端于晚清的中国法律近代化是近代中国社会发展变迁的必然结果，对中国法制的进步与文明具有深刻的影响。中国法律近代化的演变进程，始终贯穿着批判与吸收的矛盾冲突。本文主要从法律文化形态、法律制度改革、社会历史条件及其发展过程论述中国法律近代化的特点，其西方先进法的引进、法律人才的培养、立法技术的改良、司法制度的变革，对我国今天的法律现代化有着重要的参考价值。对中国法律近代化特点的研究探讨，不止是在于弘扬传统，而且在于它能对我国当前法制现代化事业诸多启示。

On China's laws of the main features of modern times

前 言
中国的法律近代化是指中国法律走出中华法系的固有格局而与西方工业社会法律接轨的过程。自十九世纪鸦片战争以来，随着西方列强的资本输出与殖民扩张，使得中国法律与西方资本主义法律不断碰撞、融合。因此在一定程度上可以说，中国法律近代化实际也就是中国封建传统法律向资本主义法律形态转型的过程。
中国法律的近代化，经历了三个主要时期，中华法系从而宣告瓦解，中国法制也就正式迈入了近代历史。一、清末法制改革：清末修律是清末法制改革的重要组成部分，它对中国传统法律进行了重大而深刻的改革，引进了近代的法律思想、原则，客观上促进了中国法律近代化的发展，在中国法律近代化历史上具有重要地位和深刻影响。二、南京临时政府：主要从法律上确认资产阶级共和制度，以“去专制之淫威，谋人民之幸福”，“人权神圣”为中心，颁行了一系列反映革命主要精神的单行法律、法令。三、南京国民政府：按照西方资本主义国家“三权分立”的原则，对司法制度进行了改革，完成了司法制度的近代转变。而最终作为南京国民政府时期基本法典的《六法全书》的出现，其六法体系最终建立，标志着近百年的中国法律的近代化的最终完成。
