劳动者与用人单位之间为确立劳动关系,依法协商达成的双方权利和义务的协议,称为劳动合同或劳动契约。劳动合同是确立劳动关系的法律形式。按照劳动合同的规定,劳动者加入企业、个体经济组织、事业组织、国家机关、社会团体等用人单位,成为该单位的成员,承担一定的工种、岗位或职务工作,并且遵守单位内部规则和其他规章制度;企业、个体经济组织、事业组织、国家机关、社会团体等用人单位则按照劳动者的劳动数量和质量支付劳动报酬,并且根据劳动法规和双方协议提供必要的劳动条件,保证劳动者享受本单位成员应该享受的各种权利和福利待遇。随着市场经济体制的建立和发展,劳动关系也变的越来越复杂,劳动者的弱势地位也越来越明显。在经济利益的趋使势下,在加上自身强大的优势地位,实践中,用人单位利用法律赋予的单方解除权违法解除劳动合同的现象屡屡出现,阻碍了经济的发展和社会的稳定。本文将就这一问题进行论述,首先将会介绍劳动合同的基本理论,包括劳动合同的概念特点等等;接下来介绍实践中用人单位在单方解除劳动合同时出现的问题以及原因;最后,论述当前劳动法中存在的缺陷以及如何完善。
